Reasons for Complex Divorces
Complex divorces occur for a number of reasons. Some of the factors that can make a divorce more complicated include (but are certainly not limited to) the following:
- Infidelity by either spouse. Infidelity and other complications in a marriage can make it hard for the couple to be in the same room, let alone come to an agreement on the divorce settlement.
- Children, including step-children or children from a previous marriage. Battling for child custody is one of the biggest complications surrounding any divorce which needs to be handled with utmost compassion and care, not only for the parents but also for the sake of the children.
- Income issues, including child support, alimony payments, large amount of debts, business partnerships in a marriage and large differences in income of spouses
- Lack of a pre-nuptial agreements
- Large estates, assets, and trust funds
Property Division Concerns
One of the biggest concerns surrounding any divorce proceeding is property division. There is no way to directly split a property in half. While some couples will ‘buy the other out’ and keep the house, others will sell the house and split the profits. However, in some instances neither of these methods is appropriate, either because both parties want the house or both parties assume that they deserve to keep the house, no questions asked.
