Many people dealing with family law matters have a lot of questions about the process. Here’s a question we hear a lot from our clients: “If we start the court process does that mean we will have to go to trial?” That’s our topic for today’s article.

Starting the Court Process

The short answer is no – starting the court process doesn’t necessarily mean that you will have to go to trial. Once initiated, the court process allows for many different opportunities to settle your case without the need to go to trial, if that is the route you prefer. The benefits of initiating the court process are:

  • (a) deadlines will be put in place to ensure that the matter continues to move forward; and
  • (b) the courts are available to assist if needed along the way.
