The Appeals Process – It’s All About Timing
Under the Minnesota Rules of Appellate Procedure, a party wishing to file an appeal must typically do so within 60 days of the initial case being formally and finally decided-upon. This is done by filing a notice of appeal with the court, and seeing to it that the other party in the case is notified that they need to appear in court again. In 2008, the Court of Appeals in Minnesota, in an effort to loosen up the log jam of cases it sees on a daily basis, created a pilot program that requires all family law cases to undergo mandatory mediation prior to being considered for appearance before an appellate judge. This new requirement generally means that your case may be resolved much sooner, and much more economically than ever before.
