Appeals – It’s Not Over ‘Til It’s Over

Losing a case in court or having it not go entirely in your favor is the sad risk one takes when they decide to litigate an issue. However, that does not mean that your case is done, that you should accept what you’ve been given and go home. Most judgments and divorce decrees may be resubmitted to the courts through appealing a judgment, also known as the appellate process. Because there are strict rules, deadlines, and guidelines governing what may be appealed and when it may be submitted for consideration by the court, securing the help of a knowledgeable, competent attorney early in the process will help guard against the loss of time and money later on down the line. The Minnesota divorce attorneys at Heimerl & Lammers know their way around the courtroom, and the complicated appellate rules are second nature to them. Feel free to contact us to see how we can help you achieve positive results during your second attempt at justice.

The Appeals Process – It’s All About Timing

Under the Minnesota Rules of Appellate Procedure, a party wishing to file an appeal must typically do so within 60 days of the initial case being formally and finally decided-upon. This is done by filing a notice of appeal with the court, and seeing to it that the other party in the case is notified that they need to appear in court again. In 2008, the Court of Appeals in Minnesota, in an effort to loosen up the log jam of cases it sees on a daily basis, created a pilot program that requires all family law cases to undergo mandatory mediation prior to being considered for appearance before an appellate judge. This new requirement generally means that your case may be resolved much sooner, and much more economically than ever before. Still, as with most areas involving appellate procedure, the help and guidance of a knowledgeable, experienced attorney helps make the process less aggravating and ultimately less expensive.
